GENERAL CONDITIONS OF USE (GCU)

ARTICLE 1: COMPANY INFORMATION

The RecupLounge website (hereinafter referred to as ‘RecupLounge’) is operated by RecupLounge Fellay & Métrailler SNC, a general partnership registered in the Swiss Commercial Register under the number [registration number], whose registered office is located in Sion.

Use of the Site implies unreserved acceptance of these General Terms and Conditions of Use (GTCU).

ARTICLE 2: INTELLECTUAL PROPERTY

The content of the Site, including but not limited to text, images, logos, trademarks and databases, is protected by Swiss intellectual property law and belongs exclusively to RecupLounge or its partners.

Any unauthorised reproduction, distribution or modification of the content of the Site is prohibited and may be subject to legal action in accordance with the Federal Law on Copyright and Neighbouring Rights (LDA, RS 231.1).

ARTICLE 3: PROTECTION OF PERSONAL DATA

3.1 Data collection and processing

Users' personal data is collected and processed in accordance with the Federal Data Protection Act (LPD, RS 235.1) and, where applicable, the General Data Protection Regulation (RGPD) for residents of the European Union.

The data collected is used solely for the purposes of the services offered by the Site and is only passed on to third parties with the User's consent or in the event of a legal obligation.

3.2 Users' rights

In accordance with the DPA, Users have the right to access, rectify and delete their personal data. They may exercise these rights by sending a written request to paulfellay2000@gmail.com or by post to info@recuplounge.com.

ARTICLE 4: COOKIES AND TRACKING TECHNOLOGIES

The Site uses cookies in order to improve the User experience and analyse traffic.

The User may configure his/her browser to refuse cookies, although this may affect certain functionalities of the Site.

ARTICLE 5: LIABILITY

5.1 Site availability

RecupLounge makes every effort to ensure the availability and proper functioning of the Site, but does not guarantee uninterrupted access.

RecupLounge cannot be held responsible for temporary interruptions due to technical reasons, maintenance or force majeure.

5.2 Limitation of liability

Users use the Site at their own risk. RecupLounge declines all liability in the event of damage resulting from the use of the Site, except in the event of intentional fault or gross negligence in accordance with the Swiss Code of Obligations (CO, RS 220).

ARTICLE 6: APPLICABLE LAW AND DISPUTE RESOLUTION

These GCU are governed by Swiss law.

In the event of a dispute, the parties will endeavour to find an amicable solution. In the absence of agreement, any dispute will be submitted to the competent courts of the canton of Valais, subject to the mandatory provisions of Swiss law.
