Scope of the general terms and conditions of sale & Generalities

 

ARTICLE 1.1: SCOPE OF THE GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions govern the relationship between RecupLounge and any seller (second-hand shops, resale companies, individuals) wishing to sell clothing via the platform. RecupLounge is a marketplace specialised in the sale of second-hand fashion items, respecting the principles of sustainable development and the circular economy.

RecupLounge is currently being structured and is aiming to be registered with the Registre du Commerce du Canton du Valais.

 

ARTICLE 1.2: WEBSITE AND FUNCTIONALITIES

The website accessible at https://www.recuplounge.com is a sales and purchasing platform specialising in second-hand fashion products. The GTC define the terms and conditions for the purchase and sale of products as well as the rights and obligations of the parties.

 

ARTICLE 1.3: MEMBERSHIP AND REGISTRATION

The creation of a customer account is required to access certain services. Registration is free and each customer must provide a valid e-mail address. The customer is responsible for his or her login details.

 

ARTICLE 1.4: GENERAL INFORMATION

In the event of force majeure, the obligations of the parties are suspended. The services are provided as is and RecupLounge does not guarantee an error-free supply. The GTC form a contractual whole and are binding between the parties.

 

2. General conditions specific to the seller

 

ARTICLE 2.1: CONDITIONS FOR SUBMITTING AN ITEM

The deposit of a product is free of charge. The seller must have legally come into possession of the products deposited and these must comply with the law. Récup'lounge reserves the right not to accept certain products and to withdraw questionable products from sale.

 

ARTICLE 2.2: DEPOSIT CONTRACT AND SELLER'S COMMITMENTS

Following inspection of the products, a confirmation email is sent to the seller. By sending products to Récup'lounge, the seller agrees to the sale of the products for the duration of the contract. The seller guarantees the legality and ownership of the products.

 

ARTICLE 2.3: COMMISSION

RecupLounge's commission is 40% of the sale price. The seller therefore recovers 60% of the sale price minus certain management costs. The selling price cannot be lower than the minimum price set by RecupLounge.

 

ARTICLE 2.4: FIXING THE SELLING PRICE

The selling price is determined in agreement with the seller, but RecupLounge can advise on the pricing according to the market and trends. The seller is free to propose a price, but RecupLounge can recommend an adjustment to ensure competitiveness on the market.

 

ARTICLE 2.5: PAYMENT TO THE SELLER

18 days after the sale, the seller's kitty will be credited. The seller has several options to use this kitty.

 

ARTICLE 2.6: RECOVERY OF UNSOLD PRODUCTS

RecupLounge takes care of the shipping of the products to the buyers, under conditions defined with the seller, including the use of eco-responsible packaging.

In case of unsold products after a period of 6 months, the seller can :

Recover the items for a shipping fee.

Give the items to RecupLounge for recycling or donation for solidarity or ecological purposes.

If the item is in poor condition or does not meet standards, RecupLounge may decide to recycle it or treat it according to its policies.

If the seller does not respond, the unrecovered products become the property of RecupLounge.

 

ARTICLE 2.7: SELLER RESPONSIBILITIES AND DISPUTES

The seller guarantees that the items are genuine and in condition as described on the platform. RecupLounge reserves the right to delete an ad or suspend an account in case of suspected fraud, counterfeiting or non-compliance with the GTC. The seller assumes full legal responsibility for its products, including any dispute relating to their authenticity, condition or conformity.

RecupLounge is insured for civil liability risks. These GTC form a contractual whole and are binding between the parties.

 

3. General conditions specific to the buyer

 

ARTICLE 3.1: PRODUCT SHEET

RecupLounge creates a product sheet for each product that is put online, describing its condition, size, composition and brand.

 

ARTICLE 3.2: PURCHASING PROCESS

Buyers can order directly on the website with secure payment via credit card, PayPal, TWINT or other suitable solutions. 

 

ARTICLE 3.3: PRICES

Prices are quoted in Swiss francs and include all taxes. RecupLounge reserves the right to modify its prices at any time.

 

ARTICLE 3.4: DELIVERY AND RECEPTION

Orders are dispatched from Switzerland according to the delivery times and costs indicated on the website.

 

ARTICLE 3.5: RETURN AND REFUND POLICY

The Buyer may request a return and refund in accordance with RecupLounge's return policy.

The Buyer can, if they wish, make a return request within 7 calendar days of receiving the order, using this returns interface, with an email address and the order number.

The Buyer must inform RecupLounge by sending an email to info@recuplounge.com.

The Buyer must return the Product in the same condition in which it was received, otherwise RecupLounge will not be able to refund the Buyer and the Product will be kept by RecupLounge.

Returns are charged at 9.90CHF per shipment.

4. Data Protection and Confidentiality

RecupLounge collects personal data solely for the management of orders and transactions. This data is neither resold nor shared with third parties for commercial purposes.
In accordance with the Data Protection Act (DPA) and the General Data Protection Regulation (GDPR), any user may request the deletion of their data by sending an email to info@recuplounge.com.

5. Liability and Limitations

RecupLounge is not responsible for any loss, theft, or damage occurring after the shipment of items by a third-party provider. In case of delivery or product issues, the buyer should contact the seller or the relevant shipping company directly. RecupLounge shall not be held liable for technical malfunctions of the website or any temporary inability to access the platform.

6. Dispute Resolution

In the event of a dispute, an amicable resolution will first be sought. If no mutual agreement is reached, the dispute will be submitted to the competent courts of the canton of Valais.

7. Modification of the Terms and Conditions

RecupLounge reserves the right to modify these Terms and Conditions at any time. The new terms will apply from the moment they are published on the website. By continuing to use the platform, sellers and buyers automatically accept the new conditions.
